1. Contact form

If you send us personal data as part of an inquiry, feedback or message about our services or products or fill out and send our corresponding Internet contact form, we process and use this data exclusively to process your request, your inquiry or to answer it your request to us. 2. What is personal data?

Personal data is individual information about personal  or factual circumstances of a specific or identifiable person. This includes information such as your name, your e-mail address, your address and usage data such as your IP address. In Switzerland, personal data also refers to legal entities.

If the processing of personal data is necessary and there is no legal basis for such processing, TRICON AG generally obtains the consent of the person concerned. This consent also relates to the transfer of personal data to external service providers and third parties, as described below. You can revoke this consent at any time without affecting the legality of the processing carried out on the basis of the consent up to the revocation.

4.Cookies

The TRICON AG website uses session-related cookies. These are small text files that are stored on the computer used by the user as soon as he has logged in. As a result, the operator automatically receives certain data such as the IP address, browser used, operating system about your computer and your connection to the Internet. After successfully logging out of the  website, the cookies are deleted again. Each user can set the permission of cookies in his browser. In order to be able to use the full functions of the website, cookies must be allowed. If this is not the case, only limited use of the website is possible.

5.Google Analytics

The TRICON AG website uses Google Analytics and Google Remarketing, an advertising analysis service provided by Google Inc.  Google Analytics uses so-called cookies, text files that are stored on your computer and analyze your use of the website enable. Google saves this data as usage profiles and uses them, for example, for advertising purposes, market research, etc. Such an evaluation is carried out in particular (also for users who are not logged in) to provide needs-based advertising. You have the right to object to the creation of these user profiles, whereby you must contact Google Inc. to exercise this right.

1. Will my data be stored and for how long?

 

If an offer and its acceptance lead to a contract with TRICON AG, the personal data (master data) will be used and stored for the duration and implementation of the respective contract content. Other data processed for the implementation of the respective subject matter of the contract (e.g. contract-specific data transmitted by the customer) will be deleted at the latest upon completion of the respective order, unless further storage is carried out on behalf of and in accordance with the instructions of the customer and/or to process the respective contract content serves, or is required to protect legitimate interests of TRICON AG, or to fulfill statutory storage obligations.

TRICON AG does not use automatic decision-making or profiling.

2. Will my data be passed on?

 

Insofar as this is necessary for the fulfillment and within the scope of the respective contract content, TRICON AG will transmit the personal data to external service providers (e.g. printers, etc.). TRICON AG contractually ensures that the respective recipients of personal data are subject to the same data protection obligations; compliance with the same is the responsibility of the external service providers involved.

Otherwise, TRICON AG will not pass on personal data to third parties unless this is necessary to fulfill a contractual agreement, the client expressly consents to the transfer of his data, or TRICON AG due to mandatory legal provisions, a court decision or an official order for transfer is obliged.

3. Is my data protected?

 

TRICON AG will only entrust the processing of personal data in connection with the respective order to personnel who have been instructed in accordance with the legal requirements and who are bound to confidentiality. Appropriate measures ensure that this staff only processes personal data on instructions from TRICON AG, using technical and organizational security measures with the aim of adequately protecting personal data. These security measures are checked regularly and continuously improved in line with technological developments. This also includes the use of encrypted connections (SSL) when transmitting personal data through our website  (e.g. contact form).

Data protection for applications

 

The person responsible for processing collects and processes the personal data of applicants for the purpose of processing the application process. The processing can also take place electronically. This is particularly the case if an applicant submits the relevant application documents electronically, e.g. by email  to the person responsible. If an employment contract is concluded, the transmitted data will be stored in compliance with the statutory provisions. If no employment contract is concluded, the application documents will be automatically deleted two months after notification of the rejection decision, provided that deletion does not conflict with any other legitimate interests of TRICON AG. These are, for example, a procedure according to the General Equal Treatment Act (AGG).

1. Provision of personal data

2. Legal basis for processing personal data

 

Art. 6 Para. 1 a DS-GVO is the legal basis for TRICON AG for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary to fulfill a contract to which the data subject is a party, which is the case, for example, in processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Art 6 paragraph 1 b GDPR. The same applies to such processing operations that are necessary to carry out pre-contractual measures, for example in the case of inquiries about our products or services. If TRICON AG is subject to a legal obligation which requires the processing of personal data, such as for the fulfillment of tax obligations, the processing is based on Art. 6 Para. 1 c DS-GVO. In rare cases, it is conceivable that the processing of personal data will be necessary to protect the vital interests of the data subject or another natural person.  Then the processing would be based on Art. 6 Para.1 d GDPR are based. Ultimately, processing operations could be based on Art. 6 Para.1 f GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of TRICON AG or a third party, provided that the interests, fundamental rights and fundamental freedoms of the person concerned do not prevail.
